On May 28 Georgian Bar Association Ethics Commission met online with USAID/PROloG Ethics Expert Mr. James Moliterno, who provided assistance in development of ethical obligations and procedures for intern lawyers.

Mr. Moliterno presented his findings regarding the application of ethics code to lawyers and interns based on the example of 29 European Countries and the United States. He also spoke about the character fitness commission issuing licenses to practice law in the US. GBA Executive Director Giorgi Tshekhani, GBA Ethics Commission Member Anna Loria and Lawyer Tamar Khubuluri also spoke and expressed the main concerns GBA faces after the standard of becoming a certified lawyer has been changed to require a professional adaptation program, and after the rights and obligations of intern lawyers will be expanded as a result of amendments to the Law on Advocates.

It has been agreed that Mr. Moliterno will develop recommendations on the following issues:

  • Who should submit ethical complaints against lawyer interns;
  • What is the proper timeframe for hearing the complaint by the Commission;
  • What are the procedures for hearing ethics complaints against lawyer interns;
  • What should the appeal procedure be;
  • The role of the Executive Board in determining the forms of punishment;

USAID/PROLoG has been working with the Georgian Bar Association to strengthen its capacity since 2015.
