Article 42 of the Constitution - Enhancing Execution of the ECtHR Judgments and Decisions of the UN Treaty Bodies Related to Criminal Justice and Judiciary through Research and Advocacy

Project description: The project aimed to promote international human rights standards in the justice sector by supporting development of mechanisms for execution of judgements delivered by the European Court of Human Rights and the UN Treaty Bodies against Georgia. The project studied the ECtHR and UN judgments and decisions concerning criminal cases and cases involving judges. The project team also analyzed the existing legislative framework, reviewed relevant action plans and reports prepared by the Ministry of Justice, monitored the work of the Parliament Committees and explored the other countries’ best practices of parliamentary supervision. The project team monitored reopened cases in the Georgian courts. The results of these activities were included in the report assessing effectiveness of the existing execution mechanisms and providing recommendations for their improvement. The project team also developed interventions to the Council of Europe Committee of Ministers. At the local level, the project team provided legal support to applicants and victims in five individual cases pending investigation and/or court proceedings. The project findings were presented at the conference engaging representatives of the Parliament, the Ministry of Justice and judiciary.
